New York Representative Highlights Risk of Non-Citizen Voter Registration

Rep. Nicole Malliotakis (R-NY) and local officials raised concerns about a New York City contract clause that, she alleges, could enable thousands of non-citizens to register to vote.

The focal point of Malliotakis’s concern lies within a contract between New York City and Homes for the Homeless, an organization that offers shelter and services to families in NYC, including operating a migrant shelter on Staten Island. 

Malliotakis pointed out a particular section within the contract that stipulated the compulsory dissemination of voter registration details to individuals who maintain regular interaction with the organization. She asserts that this includes undocumented immigrants, as per her allegations.

In a press release, Malliotakis emphasized the sanctity of the electoral system, stating, “The right to vote is a sacred right given only to United States citizens, and certainly not one provided to those who crossed over our border illegally and made their way to New York City last month.”

New York’s Voter Registration Challenges

However, the legal grounds for Malliotakis’s concerns hinge on local law in a state of legal uncertainty. 

In June 2022, a judge in the state of New York invalidated a law that permitted hundreds of thousands of non-citizen residents to participate in local elections by casting their votes.

Following that, the city appealed against this decision, claiming purported discrepancies with state laws and expressing hopefulness about the possibility of a reversal in their favor.

In contrast, Homes for the Homeless reaffirmed its dedication to furnishing housing and support services for families experiencing homelessness. Their emphasis remains on delivering educational, employment, and social services tailored for both parents and children in need.

This development unfolds against the backdrop of ongoing legal disputes and differing interpretations regarding voter registration at shelters, underscoring the complexities surrounding electoral integrity and immigrant participation in the democratic process in New York City.
