ICE Detains MS-13 Gang Member Released Despite Prior Manslaughter Conviction

Recent developments include the December 12th arrest by ICE of a 26-year-old Honduran illegal immigrant who was verified as an MS-13 gang member. 

This individual, convicted of voluntary manslaughter in 2016, was supposed to be transferred to ICE custody for deportation after serving a portion of his sentence. 

Unfortunately, he was released in 2019 due to the jurisdiction’s failure to honor ICE detainers, sparking concerns regarding public safety and the effectiveness of sanctuary policies.

The case of this individual dates back to 2014 when he arrived in the United States as an unaccompanied minor. 

Despite encounters with law enforcement, including a conviction for resisting arrest in 2016, the severity of his criminal activities escalated. He faced charges ranging from first-degree murder to possession of a firearm by a minor. 

Despite ICE lodging an immigration detainer to assume custody upon his release, the county disregarded it, leading to his release in January 2019.

ICE Frustration and Emphasis on Public Safety

The consequences of this release were dire. For almost five years, this individual remained at large, posing a significant threat to the public. 

Finally, ICE managed to apprehend him outside his residence in Hyattsville, placing him in their custody pending removal from the country.

This incident highlights the ongoing clash between ICE’s enforcement objectives and sanctuary policies adopted by certain jurisdictions. 

ICE officials have consistently expressed frustration with these policies, emphasizing their adverse effects on public safety. ERO Baltimore’s acting Field Office Director, Darius Reeves, denounced the failure to honor ICE detainers, stressing the danger posed by violent noncitizen criminals.

The arrest underscores the complex challenges faced in balancing immigration enforcement and community safety. While sanctuary policies aim to protect undocumented immigrants, instances like these raise concerns about the handling of individuals with violent criminal histories.
