Hunter Biden’s legal team vigorously defended him against federal gun charges, presenting a strong array of arguments to dismiss the allegations.

Filed on Tuesday, these legal maneuvers sought to bolster the case for dismissing charges brought forth in September, which notably included an accusation of firearm possession during narcotic use.

Responding to recent prosecutorial filings indicating the discovery of a white powdery substance on a leather pouch containing Biden’s firearm, his legal representatives underscored significant concerns. 

A member of Biden’s legal team claims that there are questions over the legitimacy and integrity of the so-called smoking pouch evidence because testing it took five years. They also emphasized the lack of incriminating texts that would have suggested drug usage on the day of the purported handgun purchase.

Emphasizing a crucial point, Biden’s attorneys pointed out the indictment’s failure to assert that Biden was under the influence of illicit substances at the time of purchasing the firearm. They argued vehemently against the allegations, contesting the notion of politically motivated prosecution and challenging the legitimacy of Special Counsel David Weiss’ appointment to oversee the case.

Abbe Lowell, an attorney representing Biden, seized upon the prosecutors’ filings as further ammunition for their claim of selective and vindictive prosecution, citing political pressure instigated by former President Donald Trump and his allies. Lowell contended that such pressure had prompted prosecutors to breach non-prosecution agreements and disregard procedural norms.

In their filings, Biden’s legal team raised questions about Weiss’ eligibility as special counsel, citing his prior role as US Attorney for Delaware and the regulations governing independence from the federal government. They also invoked an appeals court ruling on firearm possession, advocating for a trial delay until the Supreme Court deliberates on the matter.

Additionally, Biden’s attorneys reiterated arguments for immunity conferred to him through a diversion agreement last year, challenging prosecutors’ insistence on probation approval as a precondition for the contract’s validity.

Facing both gun and tax-related charges, Hunter Biden maintains his innocence. Meanwhile, amid ongoing legal battles, he is scheduled to appear for a closed-door deposition before House Oversight and Judiciary panels later this month, amidst a backdrop of heightened political scrutiny from House Republicans.
