Attorney General Merrick Garland revealed on Wednesday that Special Counsel Robert Hur has completed his year-long investigation into President Joe Biden’s handling of secret documents.

The highly anticipated report is on the verge of being released soon, with plans for its imminent publication to be shared with both Congress and the general public.

While Garland refrained from divulging the report’s conclusions, he assured transparency, affirming his commitment to disclose as much of the document as possible. 

However, this disclosure awaits completion of a White House review, anticipated to conclude by week’s end, to address potential concerns regarding executive privilege.

The investigation delved into the mishandling of classified materials by President Biden during his tenure as a US senator and vice president, with sensitive documents discovered both at his Delaware residence and a private office used during the interregnum between his vice presidency and assuming the presidency.

The denouement of this probe arrives at a crucial juncture for President Biden, navigating a charged political atmosphere amidst his reelection bid. 

Resolving Legal Uncertainties for Biden

While the inquiry’s conclusion is poised to dispel legal uncertainties surrounding Biden, potential criticism regarding his management of classified records could dent his capacity to challenge his presumed opponent, Donald Trump, who faces a pending indictment over similar allegations.

However, critics, likely including Trump and his Republican allies, may question the investigation’s legitimacy, given its initiation by the Biden Justice Department. To mitigate perceptions of bias, Garland appointed Hur, a former US attorney during the Trump administration, to oversee the Biden probe.

Unlike the investigation into Trump, which yielded numerous felony charges, the outcome of the Biden inquiry is anticipated to differ. Notably, Justice Department policy precludes the indictment of a sitting president, and no evidence has surfaced to suggest Biden’s deliberate retention of classified documents.

Nevertheless, scrutiny persists over the delayed and incomplete disclosure of the discovery of classified materials at the onset of the investigation. 

With Biden’s cooperation with Hur’s team in a voluntary interview at the White House last fall, the impending release of the report holds significant implications for the political landscape.
