In a recent filing, Trump’s legal team cited an upcoming Supreme Court case involving Joseph Fischer, a defendant implicated in the January 6, 2021, attack on the US Capitol. The outcome of this case, which concerns whether Fischer can be prosecuted for obstructing an official proceeding, may have implications for Trump, who faces similar charges.

The attorneys asserted that it would be illogical to proceed with a complex criminal trial while a related case that could invalidate some charges is pending before the Supreme Court. Trump’s defense team emphasized the need for prudence and judicial efficiency in handling the proceedings.

This filing comes in response to a submission by Special Counsel Jack Smith, who urged the Supreme Court to reject Trump’s request for further delay and address the issue of presidential immunity promptly.
