Texas Supreme Court Justice John Devine is facing additional questions about his impartiality after a video surfaced this week in which he claimed that Democrats want to cheat against expected Republican presidential nominee Donald Trump in the 2024 election. “Do you think the Democrats are going to roll over and let Trump be president again?” Devine asked during a keynote speaker at the Texas Tea Party Republican Women’s 2023 Christmas gala. “Do you think they’ll just walk away, find Jesus, and have an honest election? “I do not think so.”

Devine is a longtime anti-abortion activist who believes church-state separation is a fallacy. As a state district judge in Harris County in the 1990s, he battled to have a copy of the Ten Commandments displayed in his courtroom. In his successful 2012 campaign for the Texas Supreme Court, he claimed to have been arrested 37 times during anti-abortion protests in the 1980s, and he has since been a steadfast supporter of conservative Christian voters in Texas. Devine narrowly survived a GOP primary challenge last month centered on his ethics, and he will now face Democrat Christine Vinh Weems in the November general election.

Devine then commended Sen. Paul Bettencourt, R-Houston, who championed many Harris County-related bills following the 2020 elections. Last year, the Texas Supreme Court declined to overturn a Bettencourt-authored bill that eliminated Harris County’s elections administrator post. Bettencourt, who attended Devine’s address, responded with praise: “You’re one of the reasons why we do win fights at the Supreme Court,” he told Devine. In a statement released on Saturday, Harris County Attorney Christian Menefee slammed Devine’s remarks, calling them “shockingly inappropriate” and linking them to a greater disdain for judges.
