Lufkin Subdivision Files Lawsuit To Stop Truck
A subdivision of Lufkin has filed a lawsuit to stop RaceTrac, which operates a chain of gas stations, from moving forward with its plans to build a truck stop within the “master-planned community.”
Livingston FD extinguisher fire at an apartment complex, residents displaced.
Residents of the Crown Colony Improvement Association attended a meeting at City Hall in early April to protest the RaceTrac supermarket and an assignment order was signed Friday, assigning the case to the 217th Judicial District Court in Angelina County.
According to a statement from the subdivision’s attorney’s RaceTrac plans to build the truck stop just steps away from private family homes, at the corner of College Drive and U.S. Highway 69. The plans include an 8000-square-foot truck stop with convenient access, store, several rows of gas and diesel pumps and multiple parking stalls for 18-wheelers.
The association’s attorneys argued that none of RaceTrac’s plans meet the subdivision’s restrictions, which do not allow use of the property as a truck stop, and asked the court to take action and halt construction.
Moreover, a press release said aht this can “cause significant decreases in Crown Colony homeowner’s property values, and create a long list of nuisance causing conditions including increase traffic, noise, air pollution, light pollution, invasion of residents privacy within their homes and other adverse effects”.
