DALLAS – Texas Attorney General Ken Paxton has appealed a ruling by a Dallas judge that upholds the State Fair of Texas’ gun ban for this year. The ban prohibits firearms on the fairgrounds, even for those with a license to carry.
Paxton argues the ban is illegal under Texas law, as the State Fair is held on government-owned property. However, the State Fair of Texas, a nonprofit organization, contends that it can enforce the ban since it leases the land from the City of Dallas for the fair’s duration.
In response, Paxton filed a lawsuit against both the City of Dallas and the State Fair, seeking to prevent the ban from taking effect. Last week, a Dallas judge ruled against Paxton, leading him to appeal the decision.
“The City of Dallas and the Texas State Fair are not above the law,” Paxton said in a statement, emphasizing his intent to protect Texans’ Second Amendment rights. He has requested an emergency ruling by Tuesday, with the option to appeal to the Texas Supreme Court if necessary.
This gun ban follows a shooting at the State Fair last October that injured three people. The shooter, Cameron Turner, did not have a license to carry. Interestingly, Paxton previously supported similar bans by non-profits, but withdrew that position earlier this month after filing the lawsuit.
